Gli insiemi di macchine o le installazioni complesse — normalmente chiamati anche impianti o linee di produzione — sono macchine.

Per installazioni complesse s'intende un insieme di macchine, apparecchi e dispositivi che, per contribuire allo stesso risultato, di solito una stessa produzione, sono disposti e installati in modo tale da essere solidali nel funzionamento. La guida all'applicazione della direttiva 2006/42/CE a proposito della definizione di insieme di macchine precisa:

§38 […] The definition of assemblies of machinery indicates that assemblies are arranged and controlled so that they function as an integral whole in order to achieve the same end.

For a group of units of machinery or partly completed machinery to be considered as an assembly of machinery, all of these criteria must be fulfilled

— the constituent units are assembled together in order to carry out a common function, for example, the production of a given product;

— the constituent units are functionally linked in such a way that the operation of each unit directly affects the operation of other units or of the assembly as a whole, so that a risk assessment is necessary for the whole assembly;

— the constituent units have a common control system.

A group of machines that are connected to each other but where each machine functions independently of the others is not considered as an assembly of machinery in the above sense.The definition of assemblies of machinery does not necessarily cover a complete industrial plant consisting of a considerable number of machines, assemblies of machinery and other equipment originating from different manufacturers. However, for the application of the Machinery Directive, such large installations can usually be divided into sections which may be considered as assemblies of machinery, for example, raw material unloading and reception equipment - processing equipment - packaging and loading equipment. In that case, any risks created by the interfaces with the other sections of the plant must be covered by the installation instructions.

La guida quindi riconosce che il concetto di insieme di macchine non può essere esteso troppo (per esempio fino a ricomprendere un intero stabilimento industriale) in quanto diventerebbe di fatto ingestibile; in questi casi è ragionevole definire delle sezioni di impianto che costituiscono degli “insiemi parziali” e quindi gestire i rischi che si possono venire a creare tra le varie sezioni nell'ambito della valutazione dei rischi complessiva dell'intero impianto.

Un altro elemento che aiuta a definire il concetto di insieme di macchine è che il sistema di comando sia comune a più macchine; questo coerentemente con la definizione fornita dalla direttiva 2006/42/CE [articolo 2, lettera a), quarto trattino]:

insiemi di macchine, di cui al primo, al secondo e al terzo trattino, o di quasi-macchine, di cui alla lettera g), che per raggiungere uno stesso risultato sono disposti e comandati in modo da avere un funzionamento solidale

Le macchine che costituiscono l'insieme sono normalmente regolamentate dal regime dell'allegato II, lettera B, ovvero non sono marcate CE e sono accompagnate da una dichiarazione di incorporazione, ma possono anche essere macchine in grado di funzionare in modo indipendente e, come tali, marcate CE e accompagnate da una dichiarazione CE di conformità ai sensi dell'allegato II, lettera A.

La marcatura CE dell'insieme dovrà essere effettuata solo dopo che tutto l'insieme sia stato dichiarato conforme alle direttive applicabili e tale compito spetta all'assemblatore dell'insieme o all'utilizzatore finale se questi assembla più macchine per costituire un insieme complesso per uso proprio. A tale scopo dovrà essere effettuata una valutazione del rischio dell'insieme, per assicurarsi che i componenti utilizzati per la realizzazione dell'insieme siano adeguati allo scopo e che i rischi che si possono essere generati all'interfaccia tra i vari elementi che compongono l'insieme siano stati sufficientemente ridotti.

Questa prescrizione è stata chiarita dalla guida all'applicazione della direttiva 2006/42/CE:

§38 […] Assemblies of machinery are subject to the Machinery Directive because their safety depends not just on the safe design and construction of their constituent units but also on the suitability of the units and the interfaces between them. The risk assessment to be carried out by the manufacturer of an assembly of machinery must therefore cover both the suitability of the constituent units for the safety of the assembly as a whole and the hazards resulting from the interfaces between the constituent units.

È essenziale che sia identificato il fabbricante dell'insieme, ovvero il soggetto che si è occupato del suo assemblaggio; a questo proposito la guida all'applicazione della direttiva 2006/42/CE indica:

§38 […] The person constituting an assembly of machinery is considered as the manufacturer of the assembly of machinery and is responsible for ensuring that the assembly as a whole complies with the health and safety requirements of the Machinery Directive […]. In some cases, the manufacturer of the assembly of machinery is also the manufacturer of the constituent units. However, more frequently, the constituent units are placed on the market by other manufacturers, either as complete machinery that could also operate independently according to the first, second or third indents of Article 2 (a), or as partly completed machinery according to Article 2 (g).

§79 […] A person constituting an assembly of machinery is considered as the manufacturer of the assembly […]. Usually, the elements constituting an assembly of machinery are supplied by different manufacturers, however one person must assume the responsibility for the conformity of the assembly as a whole.

This responsibility can be assumed by the manufacturer of one or more of the constituent units, by a contractor or by the user. If a user constitutes an assembly of machinery for his own use he is considered as the manufacturer of the assembly.

Quindi il fabbricante dell'insieme può essere l'utilizzatore (che assembla l'insieme per uso proprio), il fabbricante di una o più delle parti costituenti l'insieme oppure un soggetto terzo (per esempio una società di ingegneria).

Quando viene costituito un insieme di macchine è essenziale che la responsabilità della marcatura CE dell'insieme venga definita contrattualmente: qualora ciò non venga fatto, il fabbricante naturale dell'insieme sarà il soggetto che ha acquistato i vari componenti dell'insieme e li assembla, ovvero l'utilizzatore dell'insieme quando questo viene realizzato per uso proprio.

Si tenga presente che qualora l'insieme nel suo complesso venga fornito da un unico soggetto questi dovrà necessariamente marcare CE l'insieme in quanto rientrante nella definizione di macchina completa in grado di svolgere appieno un'applicazione ben determinata; in questo caso non saranno quindi possibili deroghe contrattuali.

Il soggetto che si assume questo incarico dovrà poter disporre di tutte le informazioni necessarie (per esempio dai fabbricanti delle varie componenti dell'insieme) e avere sufficienti poteri decisionali per determinare quali misure di sicurezza verranno adottate per assicurare la conformità dell'insieme ai requisiti della direttiva Macchine.

Un insieme complesso costituito da più macchine:

• deve riportare un'unica marcatura CE, apposta sull'insieme dall'assemblatore delle varie macchine; tale marcatura dovràessere apposta in un punto rappresentativo dell'insieme, in modo che sia chiaroche si riferisce all'insieme nel suo complesso;

• deve essere accompagnato da un un'unicadichiarazione CE di conformità secondo la lettera A dell'allegato II delladirettiva Macchine, redatta dall'assemblatore delle varie macchine;

• deve essere corredato da un fascicolo tecnicorelativo a tutto l'insieme; in particolare il fascicolo tecnico deve contenere lavalutazione dei rischi relativa alle interfacce tra i vari elementi costituentil'insieme complesso;

• deve essere corredato da istruzioni per l'usorelative a tutto l'insieme.

Insiemi di macchine comprendenti componenti nuove ed esistenti

È abbastanza frequente il caso di insiemi di macchine costituiti utilizzando componenti nuove ed esistenti; questo può essere, per esempio, il caso di modifica all'insieme consistente nella sostituzione di una o più macchine dell'insieme con altre più moderne.

Deve essere quindi definito in quali casi è necessario sottoporre l'insieme nel suo complesso, oppure sue parti, alle procedure previste dalla direttiva Macchine; i criteri da utilizzare sono:

• se le modifiche non variano in modo significativo la funzionalità o i rischi esistenti delle parti dell'insieme non interessate alla modifica, nessuna attività riguardante la direttiva Macchine sarà necessaria per queste parti dell'insieme; per quanto riguarda la parte interessata alla modifica:

– se le nuove componenti sono macchine che possono anche funzionare in modo indipendente dal resto dell'insieme — e sono quindi marcate CE eaccompagnate da una dichiarazione CE di conformità

— l'inserimento delle nuove componenti nell'insieme è da considerare come l'installazione di macchinenuove e quindi non è necessaria la marcatura CE dell'insieme;

– se le nuove componenti sono quasi-macchine sarà necessario effettuare una valutazione dei rischi generati dalle interfacce tra le nuove componenti e il resto dell'insieme e quindi applicare la direttiva Macchine alle nuove componenti come assemblate nell'insieme; dovrà dunque essere preparato un fascicolo tecnico relativo alle nuove componenti come assemblate nell'insiemee, per queste, redatta una dichiarazione CE di conformità, applicata una marcatura CE e, per quanto necessario, predisposte delle istruzioni per l'uso;

• se invece le modifiche mutano in modo significativo la funzionalità o i rischi esistenti nell'intero insieme, questo dovrà essere sottoposto alle procedure previste dalla direttiva Macchine; in questo caso dovrà quindi essere effettuata una valutazione dei rischi dell'insieme nella sua interezza, dovrà essere apposta una marcatura CE, redatta una dichiarazione CE di conformità e, per quanto necessario, preparate delle istruzioni per l'uso relative a tutto l'insieme.

A questo proposito la guida all'applicazione della direttiva2006/42/CE fornisce numerosi chiarimenti:

§39 Assemblies comprising new and existingmachinery

[…] In some cases, one or more of the constituent units of existing assemblies of machinery may be replaced by new units, or new units may be added to an existing assembly of machinery. The question arises as to whether an assembly of machinery comprising new and existing units is, as a whole, subject to the Machinery Directive. It is not possible to give precise criteria for answering this question in each particular case. […] However the following general guidance can be given:

1. If the replacement or the addition of a constituent unit in an existing assembly of machinery does not significantly affect the operation or the safety of the rest of the assembly,the new unit can be considered as machinery subject to the Machinery Directive and, in that case, no action is required according to the Machinery Directive for the parts of the assembly that are not affected by the modification.

The employer remains responsible for the safety of the whole assembly according to the national provisions implementing Directive 2009/104/EC […].

– If the new unit is complete machinery that could also operate independently, that bears the CE-marking and is accompanied by an EC Declaration of Conformity, the incorporation of the new unit into the existing assembly is to be considered as the installation of the machinery and does not give rise to a new conformity assessment, CE marking or EC Declaration of Conformity.

– If the new unit is constituted by partly completed machinery accompanied by a Declaration of Incorporation and assembly instructions, the person incorporating the partly completed machinery into the assembly is to be considered as the manufacturer of the new unit. He must therefore assess any risks arising from the interface between the partlycompleted machinery, other equipment and the assembly of machinery, fulfil any relevant EHSRs [Essential Health and Safety Requirements] that have not been applied by the manufacturer of the partly completed machinery, apply the assembly instructions, draw up an EC Declaration of conformity and affix the CE marking to the new unit as assembled.

2. If the replacement or the addition of new constituent units in an existing assembly of machinery has a substantial impact on the operation or the safety of the assembly as a whole or involves substantial modifications of the assembly, it may be considered that the modification amounts to the constitution of a new assembly of machinery to which the Machinery Directive must be applied. In that case, the whole assembly, including all its constituent units, must comply with the provisions of the Machinery Directive. This may also be required if a new assembly of machinery is constituted from new and second-hand units.
